I was struck by an uninsured driver on 02-10-11. Because the driver who struck me was uninsured I was forced to file a claim with my insurance company(Omni Insurance). The car was towed to CJ's collision at 6128 n beechwood Philadelphia, pa ,19138 on 02-11-11. Phone number 215-848-2836. On 02-14-11 Omni insurance sent out an appraiser to evaluate the vehicle. They then faxed an estimate on 02-15-11 totaling $5300 to CJ's collision shop. I went to the collision shop on 02-15-11 to sign paperwork giving them permission to work on my car. They then began the repairs. On 02-18-11 the insurance company then deemed my car a total loss. The vehicle is a 2005 Nissan Altima SL with 96,477 miles. The NADA value for the vehicle is 10,995. According to Omni insurance a car is deemed a total loss when the repairs reach 70% of the value of the vehicle. Omni insurance valued my car at 7,415. They then proposed a settlement offer of 5826.40. They deducted 975.00 in prior damages(which I disagree with) and 1000.00 my deductible. The settlement offer included 386.40 in sales tax. After negotiating on 02-28-11 they proposed an offer of 7835.30. The value they gave my car was 9255. Again 975.00 was deducted and my 1000.00 deductible. They including sales tax and tags/registration fee in the offer. I accepted the offer out of desperation because they also stopped paying for the rental car I was driving on 02-28-11. I work, attend school and have a child my schedule requires that I have a car so I paid out of pocket for a rental car until 03-07-11, expecting the payment to be issued to my lien holder by then so I could purchase another car. I contacted them on 03-07-11 inquiring about my payment and was informed they did not pick the vehicle up from the collision shop therefore they were not issuing a payment. The collision shop gave them a bill of 1750.00 for the repairs they did and the storage fees. The insurance company disagrees with this and refuses to pick the vehicle up and issue my payment. They have also stated this may come out of my settlement offer. The insurance company already has the title to the car and all the necessary paperwork to the vehicle but refuses to issue a payment. It has been a month since I filed my claim and I can no longer afford to pay for a rental especially since it seems I will have to purchase a new vehicle. The insurance company is low balling me and also forcing me to pay for repairs they approved then backed out of.

Some background first, i was hit from behind whilst stationary in traffic the other week by a works van. the damage was not too sever that i couldn't limp back home (sore and car bashed but still alive) got the other drivers details at the scene and reported the incident to my insurance company. As the accident was not my fault my insurer passed this to their dedicated Non-Fault (NF) accident claim company (i'll not name them at the moment) who in turn provided me with a hire car and collected my car to have it assessed for REPAIR. At no point was writing off the car mentioned. Then i got a call from the garage dealing with my car (NF appointed) a week later telling me of the damage and repair value and that the engineers working for the NF, different company again, were going to deem the car a write off, CAT D as i later found out. Now the fun part - the engineers have made an offer for settlement and to write off of my car, which is a good 500 below what is would cost to replace it with a like-for-like car in my local area (replace cost circa 2.8k-3k) they are adamant they will not repair my car even though the repairs would cost LESS than the write off - because the repair is too close to the market value and they can make a killing on salvage apparently. so fighting this out at the moment. NOW FOR THE QUESTION: They have advised me that should i wish to keep the car after they write it off (which i want to avoid if at all possible) i can accept the settlement and pay them a salvage fee to retain my car. This i understand as technically they buy my car when they write it off and then i have to buy it back. The problem is that they have a flat 30% !!! salvage fee which on their offer would almost negate me being able to get the repairs covered. What i really need to know is if anyone else has been in this position and if there is a maximum salvage fee they can charge - bearing in mind that this is my car to start with - and if there is any way i can make them drop this percentage. Forcing them to drop the percentage might not only let me repair the car after retaining but might also swing in favour of repair instead of write off if they cannot justify such a big payout for themselves. Any help here would be appreciated fast as i'm still bouncing between the parties here to get this resolved. In case your wondering the damage constitutes a bumper rear panel and a kink in the boot floor - VERY repairable.

Car insurance without a license?

Hi! I'm going to get a used car next month. I've had my permit for over a year so that means I have to take the written test again. I'm planning on taking it this month, then getting the car next month, then a few months later taking the road test. I have to practice driving in the car that I'm gonna get so my question is, can I get insurance on the car without having a license yet? My parents don't drive, so I cant get on their insurance. So what do you think is the best thing for me to do and what would be the cheapest? Thanks in advance to anyone kind enough to answer my question.:D

High cost of insurance for retirees which is using up pensions.?

I worked 33 yrs at McDonnell Douglas (Boeing) Aircraft Corporation and retired in 1996. I received a fair pension and insurance that I had to pay, which was affordable. What started out to be affordable in 1996 has now reached unaffordable in 2007. My pension is being quickly absorbed by the cost of my insurance, which is now $933 a month for just me. Needless to say my insurance costs outweigh my monthly pension allowance now. I am a cancer survivor since 1992 yet I am unable to choose another insurance provider because I am considered, like many other survivors and patients, high risk and uninsureable. I didn't ask to be dianosed with cancer. In fact, I have always taken care of myself. Why should I/we be discriminated against after 10 or more years of being cancer free.

Health Insurance for Small Business Owner?

Wanting to know how to find out two things: 1) the best health insurance coverage and 2) for the best and most affordable price. My husband is the sole proprietor of a small business he runs. He'd like to get good health insurance for the two of us but what I've looked into has been incredibly expensive for good coverage or cheaper for not-so-good coverage. Someone recently told us to look into becoming incorporated as that may help (I don't know how though). Any ideas? Thanks in advance.

I was in a car accident 4 days ago. My Mother was the passenger in my car (I was driving). I was on the off ramp getting off the freeway. All cars behind me were stopped. I was stopped waiting to make a right turn. An emergency vehicle was coming in my direction from my left. Therefore, I was waiting for the emergency vehicle to pass. The person behind me (large dodge ram truck I am in an '08 2 door Infiniti coupe) thought I went so he 'gunned it' to get in front of the emergency vehicle. Unfortunately, we had not gone so he pushed my vehicle out in front of the emergency vehicle. Luckily, I was able to turn my car out of the way. I did not hit anyone (no one was in front of me). My Mother and I were both put into a gurney and taken to a local hospital in an ambulance. We both had our seat belts on and suffered whiplash. We were released 5-6 hours later after x-rays, etc. We were both prescribed medicine. My Mother has had 3 brain tumors and has trouble with her speech etc. and any violent startling trauma can get her shaken up pretty badly and confused. I know she hit her head but, she is in pain but not nearly as much as I am. With my Mother's condition I don't know if this kind of thing can have negative effects later on. I know that my neck and back is pretty messed up. It hurts to stand for after 15 minutes or so. My car is pretty messed up and had to be towed. I plan on taking it back to the Infiniti shop to get all new parts. My car has all the upgrades in it so I want it to be taken care of. Am I allowed to take it to the Infiniti dealership or will Geico (the other persons insurance) not allow that, or does it not matter? The police gave the guy that hit us a citation. I have USAA and the other person has Geico. I just want to know exactly what to do in this situation. Since I'm out a car (I work for myself) I have been out (already) a decent amount of money for not being able to meet up with my clients. I spoke to my insurance today and they said that all my medical is covered since I had that already in my plan (without it raising my premium) and that I should get a settlement ON TOP of paying for damages to my car and getting me a rental, etc. Any advice would be greatly appreciated. I don't want to get taken for a ride. I've heard the horror stories of dealing with insurance companies. Any advice on what I should make a point of saying to the other insurance company, etc. Thanks in advance....

Minor car accident (not at fault) - should I go to my insurance or small claims court?

I was wondering if anyone could give me some advice. Last week I was involved in a minor car accident. I was at a stop light and the car behind me decided they could not wait and they tried to get by my car to make a left turn. They did not have enough room and scraped against my car with theirs. No one was hurt and no police were called. We pulled over and I got their name, phone number and address. They did not give me their insurance information and said they'd like to settle outside insurance because there are only scratches. I know it was stupid but I said okay. Also I do not have the license plate number of the car. I thought I wrote it down but I did not (I understand this is a big mistake on my behalf). We made contact over phone throughout the week and discussed repairs but suddenly they stopped answering my calls. I believe they are avoiding me. Now I am at a loss of what to do. Should I take this issue up with my insurance (at the risk of raising my premiums) or should I take this to small claims court? In either case I do not have the car's license plate so if it isn't their car will that be insufficient evidence to prove they are at fault (my word against theirs)?
